EMPLOYER LIABILITY IN THE LABOR LAW OF THE KYRGYZ REPUBLIC: THEORETICAL AND PRACTICAL ISSUES

This article examines the theoretical and practical aspects of employer liability in the labor law of the Kyrgyz Republic. The relevance of the topic is determined by the need to ensure effective protection of employees’ labor rights in the context of developing market relations and the ongoing improvement of national labor legislation. The study considers the main types of employer liability established by labor legislation, including material, administrative, and other forms of legal liability. Particular attention is paid to the problems of law enforcement practice related to violations of employees’ labor rights, delayed payment of wages, unlawful dismissal, non-compliance with occupational safety requirements, and compensation for harm caused to the life and health of employees in the course of their employment. The aim of the study is to comprehensively examine the theoretical and practical aspects of employer liability in the labor law of the Kyrgyz Republic, identify key problems in law enforcement practice, and determine the main directions for improving liability mechanisms to ensure effective protection of employees’ labor rights and promote social partnership. The methodological basis of the research consists of general scientific and special methods of legal inquiry, including analysis, synthesis, comparative legal analysis, and the formal legal method. The study analyzes the provisions of the labor legislation of the Kyrgyz Republic, international labor standards developed by the International Labor Organization (ILO), as well as scholarly works of domestic and foreign researchers devoted to issues of employer liability. The research identifies the main problems associated with the implementation of legislation in the field under consideration and determines the directions for its further improvement. It is concluded that increasing the effectiveness of employer liability mechanisms is an important prerequisite for ensuring legality in labor relations, strengthening guarantees for the protection of employees’ rights, and promoting the development of social partnership in the Kyrgyz Republic.
