В статье рассматриваются вопросы, связанные с регулированием правоотношений климатических (экологических) мигрантов, экологических беженцев и вынужденно переселившихся граждан в международном и национальном законодательствах, а также современные тенденции, связанные с оставлением мест постоянного проживания вследствие ухудшения экологической ситуации.Целью исследования является совершенствование норм международного и национального права, регулирующих права климатических (экологических) мигрантов, экологических беженцев и вынужденно переселившихся граждан в международном и национальном законодательствах. Существующее состояние международного и национального законодательства не отвечает современным вызовам, стоящим перед человечеством, и не дает четкого определения понятиям, связанным с климатическими мигрантами. Нормы международного законодательства значительно устарели, так как в период принятия действующей редакции перед мировым сообществом стояли проблемы военного характера. Между тем мир и его проблемы за последние несколько десятилетий сильно изменились. Следовательно, возникла необходимость в нормативном регулировании, отвечающем современным трендам и вызовам.Результаты исследования позволили определить проблемы в международном и национальном законодательствах, связанные с климатическими (экологических) мигрантами, экологическими беженцами и вынужденно переселившимися гражданами. Подготовлены проект международного договора о климатических мигрантах и изменения в Закон Республики Казахстан «О беженцах» и Закон Республики Казахстан «О миграции населения». Обобщена имеющаяся статистическая информация об основных регионах мира и Республики Казахстан, подверженных наибольшей миграции населения в связи с ухудшением экологических условий, не пригодных для нормальной жизнедеятельности человека.

The article discusses issues related to the regulation of legal relations between climatic (environmental) migrants, environmental refugees and internally displaced persons in international and national legislation, as well as current trends related to the abandonment of permanent residence due to the deterioration of the environmental situation.The study aims to improve the norms of international and national law governing the rights of climatic (environmental) migrants, environmental refugees and internally displaced persons in global and national legislation. The current state of international and national legislation does not meet the modern challenges facing humanity and does not provide a clear definition of concepts related to climate migrants. The norms of international legislation have become significantly outdated, since during the period of adoption of the current version, the world community was faced with problems of a military nature. Meanwhile, the world and its problems have undergone significant changes over the past few decades. Consequently, there is a need for regulatory regulation that meets modern trends and challenges.The results of the study made it possible to identify problems in international and national legislation related to climate (environmental) migrants, environmental refugees and internally displaced citizens. A draft international treaty on climate migrants, along with amendments to the Law of the Republic of Kazakhstan "On Refugees" and the Law of the Republic of Kazakhstan "On Population Migration," have been prepared. The available statistical information on the central regions of the world and the Republic of Kazakhstan, which are subject to the greatest population migration due to the deterioration of environmental conditions unsuitable for everyday human life, is summarized.
